1. Acceptance of Terms
By downloading, installing, or using KitchenKeepr, you confirm that you are at least 13 years of age and agree to these Terms and our Privacy Policy. If you do not agree, do not use the Service.
2. Account Registration
- You are responsible for maintaining the confidentiality of your account credentials
- You agree to provide accurate information when creating your account
- You are responsible for all activity that occurs under your account
- You must notify us immediately at support@kitchenkeepr.com if you suspect unauthorised access to your account
3. Permitted Use
KitchenKeepr grants you a personal, non-exclusive, non-transferable, revocable licence to use the Service for your personal, non-commercial household management purposes. You agree not to:
- Use the Service for any unlawful purpose
- Attempt to reverse-engineer, decompile, or extract the source code of the app
- Use the Service to transmit spam, malware, or other harmful content
- Attempt to gain unauthorised access to our systems or other users’ data
- Resell, sublicence, or commercialise the Service without our written consent
4. AI-Generated Content Disclaimer
KitchenKeepr uses artificial intelligence (OpenAI) to generate meal plans, recipes, and nutritional estimates. You acknowledge that:
- AI-generated meal plans and recipes are for general informational purposes only and are not a substitute for advice from a qualified dietitian, nutritionist, or physician
- Calorie and macro estimates are approximations and may not be accurate for all ingredients, brands, or preparation methods
- If you have a medical condition, food allergy, eating disorder, or specific dietary requirement, consult a qualified healthcare professional before relying on AI-generated content
- KitchenKeepr is not responsible for any adverse health outcomes resulting from following AI-generated meal plans or recipes
5. User-Generated Content
You may add recipes, household members, and other content to the Service. By doing so, you grant KitchenKeepr a limited licence to store and display that content solely for the purpose of providing the Service to you. You retain ownership of your content. You are responsible for ensuring your content does not infringe any third-party rights.
6. Intellectual Property
All software, design, text, graphics, and other content in KitchenKeepr (excluding user-generated content) are the property of KitchenKeepr, LLC and are protected by applicable intellectual property laws. You may not copy, reproduce, or distribute any part of the Service without our prior written consent.
7. Third-Party Services
The Service integrates with third-party services including Supabase, OpenAI, Google Places, and Open Food Facts. Your use of these services is subject to their respective terms and privacy policies. KitchenKeepr is not responsible for the availability, accuracy, or practices of third-party services.
8. Disclaimers
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS.
9. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, KITCHENKEEPR, LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF DATA, LOSS OF PROFITS, OR PERSONAL INJURY, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY TO YOU FOR ANY CLAIM SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM OR (B) USD $100.
10. Indemnification
You agree to indemnify and hold harmless KitchenKeepr, LLC and its officers, directors, employees, and agents from any claims, liabilities, damages, and expenses (including reasonable legal fees) arising out of your use of the Service, your violation of these Terms, or your violation of any third-party rights.
11. Termination
- You may stop using the Service and delete your account at any time from Settings → Account → Delete Account
- We reserve the right to suspend or terminate your account at our sole discretion if you violate these Terms, with or without notice
- Upon termination, your right to use the Service ceases immediately
12. Changes to These Terms
We may update these Terms from time to time. If we make material changes, we will notify you via the app or by email at least 14 days before the changes take effect. Your continued use of the Service after that date constitutes acceptance of the updated Terms.
13. Governing Law
These Terms are governed by and construed in accordance with the laws of the State of Texas, without regard to conflict-of-law principles. Any disputes arising from these Terms or the Service shall be subject to the exclusive jurisdiction of the courts located in Chambers County, Texas.
