Please read these Terms of Service (“Terms”) carefully before using KitchenKeepr. By creating an account or using the Service, you agree to be bound by these Terms and our Privacy Policy.
1. Acceptance of Terms
By downloading, installing, or using KitchenKeepr, you confirm that you are at least 13 years of age and agree to these Terms and our Privacy Policy. If you do not agree, do not use the Service. If you are between 13 and 18 years of age, you must have a parent or legal guardian’s permission to use the Service.
Age confirmation, where implemented in the app, occurs before we collect personal information beyond what is necessary to perform the age-screening function.
2. Account Registration
- You are responsible for maintaining the confidentiality of your account credentials
- You agree to provide accurate information when creating your account
- You are responsible for all activity that occurs under your account
- You must notify us immediately at support@kitchenkeepr.com if you suspect unauthorized access to your account
- You may not share your account credentials with others or allow others to access the Service through your account
3. Permitted Use
KitchenKeepr grants you a personal, non-exclusive, non-transferable, revocable license to use the Service for your personal, non-commercial household management purposes. You agree not to:
- Use the Service for any unlawful purpose
- Attempt to reverse-engineer, decompile, or extract the source code of the app
- Use the Service to transmit spam, malware, or other harmful content
- Attempt to gain unauthorized access to our systems or other users’ data
- Resell, sublicense, or commercialize the Service without our written consent
- Submit false, fraudulent, or misleading product or aisle location data
- Use automated tools or scripts to scrape, crawl, or extract data from the Service
- Misuse AI-generated content in ways that could harm others, including sharing AI-generated dietary or health content as if it were professional medical or nutritional advice
4. Subscriptions and Auto-Renewal
Subscription Plans
KitchenKeepr offers optional premium subscription plans (Individual and Family, available monthly or annually). A free trial period may be offered. Current pricing is displayed in the app at the time of purchase.
Free Trial
If a free trial is offered, you will not be charged during the trial period. Your subscription will automatically convert to a paid subscription at the end of the trial unless you cancel before the trial period ends.
Billing and Auto-Renewal
- Subscriptions are billed in advance on a monthly or annual basis, depending on the plan you select
- Payment is charged to your Apple ID or Google Play account at confirmation of purchase
- Your subscription automatically renews at the end of each billing period unless you turn off auto-renewal at least 24 hours before the end of the current period
- Your account will be charged for renewal within 24 hours prior to the end of the current period
- The renewal price will be the same as your initial subscription price unless we notify you of a price change in advance
Managing and Canceling Your Subscription
You can manage and cancel your subscription at any time through your device’s account settings:
- iOS: Settings → [your name] → Subscriptions → KitchenKeepr
- Android: Google Play Store → Profile → Payments & subscriptions → Subscriptions → KitchenKeepr
Canceling your subscription stops future charges. You retain access to premium features through the end of your current billing period. Cancellation does not delete your account or data.
Refunds
All purchases are processed by Apple (App Store) or Google (Google Play). KitchenKeepr does not directly process payments and cannot issue refunds. Refund requests must be submitted through Apple (reportaproblem.apple.com) or Google (Google Play Help Center). Each platform’s refund policy governs all refund decisions.
Price Changes
We reserve the right to change subscription prices. If we change the price of your subscription, we will notify you at least 30 days in advance. Your continued use of the Service after the new price takes effect constitutes your acceptance of the new price.
Free Tier
A free tier with limited features is available without a subscription. We reserve the right to change the features included in the free tier at any time.
5. AI-Generated Content and Health Disclaimer
KitchenKeepr provides planning, organization, and informational tools only. The Service, including any AI-generated output, is not medical advice, nutrition therapy, diagnosis, treatment, or emergency guidance, and is not a substitute for consultation with a qualified physician, registered dietitian, or other licensed professional.
You acknowledge that:
- AI-generated meal plans, recipes, and nutritional estimates are for general informational and planning purposes only
- Calorie and macro estimates are approximations and may not be accurate for all ingredients, brands, or preparation methods
- You are solely responsible for reviewing ingredient, allergy, nutrition, and safety information before relying on any recipe, meal plan, shopping list, or recommendation generated by the Service
- If you have a medical condition, food allergy, eating disorder, dietary restriction, or any other health concern, consult a qualified physician, registered dietitian, or other appropriate licensed professional before acting on AI-generated content
- If you have or suspect a medical emergency, call emergency services immediately — do not rely on this Service for emergency guidance
- KitchenKeepr is not responsible for any adverse health outcomes resulting from following AI-generated meal plans, recipes, or recommendations
Health data transmission
When you use the AI meal plan generation feature, your household dietary preferences, pantry contents, macro targets, and health profile context (including activity level and calorie goal) are automatically transmitted to OpenAI as part of the generation request. By using this feature, you consent to this transmission. See our Privacy Policy for details on how this data is handled.
6. User-Generated Content
You may add recipes, household members, and other content to the Service. By doing so, you grant KitchenKeepr a limited license to store and display that content solely to provide the Service to you. You retain ownership of your content. You are responsible for ensuring your content does not infringe any third-party rights.
Aisle Contributions
If you submit aisle location data through the community contribution feature, you grant KitchenKeepr a perpetual, royalty-free license to store and use that data (in anonymized, aggregated form) to improve the Service for all users. You represent that your aisle contribution is accurate to the best of your knowledge.
7. Intellectual Property
All software, design, text, graphics, and other content in KitchenKeepr (excluding user-generated content) are the property of KitchenKeepr, LLC and are protected by applicable intellectual property laws. You may not copy, reproduce, or distribute any part of the Service without our prior written consent.
8. Third-Party Services
The Service integrates with third-party services including Supabase, OpenAI, Google Places, Google Sign-In, Apple Sign-In, Open Food Facts, USDA FoodData Central, RevenueCat, Sentry, Resend, Mixpanel, Instacart, and Walmart. Your use of these services is subject to their respective terms and privacy policies. KitchenKeepr is not responsible for the availability, accuracy, or practices of third-party services.
When you use the “Order Groceries” feature, you will be redirected to a third-party grocery partner’s platform. Your order, payment, and delivery are governed by that partner’s terms of service and privacy policy. KitchenKeepr is not party to those transactions.
9. Disclaimers
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS. NUTRITIONAL INFORMATION AND AI-GENERATED CONTENT ARE PROVIDED FOR INFORMATIONAL PURPOSES ONLY AND MAY NOT BE ACCURATE OR APPROPRIATE FOR YOUR INDIVIDUAL HEALTH NEEDS.
10. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, KITCHENKEEPR, LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF DATA, LOSS OF PROFITS, OR PERSONAL INJURY, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATED TO THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE TOTAL AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM OR (B) USD $100.
NOTHING IN THESE TERMS LIMITS LIABILITY FOR FRAUD, WILLFUL MISCONDUCT, OR GROSS NEGLIGENCE WHERE APPLICABLE LAW PROHIBITS SUCH LIMITATION, OR FOR ANY LIABILITY THAT CANNOT LEGALLY BE LIMITED OR EXCLUDED.
11. Indemnification
You agree to indemnify and hold harmless KitchenKeepr, LLC and its officers, directors, employees, and agents from any claims, liabilities, damages, and expenses (including reasonable legal fees) arising out of your use of the Service, your violation of these Terms, or your violation of any third-party rights.
12. Termination
- You may stop using the Service and delete your account at any time from Settings → Account → Delete Account
- We reserve the right to suspend or terminate your account at our sole discretion if you violate these Terms, with or without notice
- Grounds for suspension or termination include (without limitation): submitting fraudulent data, abusing the AI generation feature, attempting to access other users’ data, or engaging in any conduct that could harm the Service or other users
- If we terminate your account without cause, we will provide a pro-rated refund for any unused portion of a prepaid annual subscription, processed through the applicable app store
- Upon termination, your right to use the Service ceases immediately. Sections 6 (IP license for aisle contributions), 7 (Intellectual Property), 10 (Limitation of Liability), 11 (Indemnification), 14 (Governing Law), and 15 (General) survive termination.
13. Changes to These Terms
We may update these Terms from time to time. If we make material changes, we will notify you via the app or by email at least 14 days before the changes take effect. Your continued use of the Service after that date constitutes acceptance of the updated Terms.
14. Governing Law and Dispute Resolution
Informal Resolution
Before filing a formal claim, you and KitchenKeepr agree to try to resolve the dispute informally. The party raising the dispute must provide written notice describing the issue and the relief requested. If the dispute is not resolved within 30 days of that notice, either party may pursue the claim through the courts as described below.
Governing Law
These Terms are governed by and construed in accordance with the laws of the State of Texas, United States, without regard to conflict-of-law principles.
Venue
Any disputes arising from these Terms or the Service that are not resolved informally shall be subject to the exclusive jurisdiction of: (a) the state district courts of Chambers County, Texas; or (b) the United States District Court for the Southern District of Texas, Galveston Division.
Nothing in these Terms prevents either party from seeking injunctive or other equitable relief in any court of competent jurisdiction for protection of intellectual property rights, confidential information, or to prevent imminent harm.
15. General
- Entire Agreement: These Terms and our Privacy Policy constitute the entire agreement between you and KitchenKeepr regarding the Service
- Severability: If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full force
- Waiver: Our failure to enforce any provision of these Terms is not a waiver of our right to enforce it later
- Assignment: You may not assign your rights under these Terms without our prior written consent. We may assign our rights without restriction.
- No Relationship: Nothing in these Terms creates a partnership, joint venture, agency, employment, or franchise relationship between you and KitchenKeepr.
